In Scotland, a servitude is a right placed over a piece of land or property for the benefit of another property.
A servitude can give someone else rights over your property or, indeed, it can confer you rights over a property belonging to someone else. Common examples of servitudes include the following:
- rights of access to property;
- rights of access to drainage and sewage provision on another’s property
- the right to draw water from a well or private water supply; or
- access to someone else’s garden.
There is no doubt that the lack of a servitude can have important implications for the use and enjoyment of a property.
